PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 27 July 1989, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory performance, with a general discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. On 7 August 1989, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a characterization of service of general, under honorable conditions.

         b. On 5 September 1989, the applicant was discharged. At the time of discharge, the applicant had completed 2 years, 10 months, and 28 days of active military service.

         c. The unit commander indicated that his specific reasons for initiating separation action were: substandard performance and three Article 15s. The commander opined that the applicant was a disruptive influence on the good order and discipline of the unit.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

          b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The evidence of record does not support the applicant’s contention that his discharge was unfair or that it was a result of racial discrimination. The evidence in the applicant’s file shows that he was counseled on numerous occasions for substandard performance; indebtedness; worthless checks; failing to adequately support his family; failing to go to his appointed place of duty; disrespect to commissioned officers; and, nonpayment of speeding and parking tickets to the German police. In addition, he received one summarized Article 15 for failing to follow instructions; a company grade Article 15 for failing to go to his appointed place of duty on divers occasions and disrespect to noncommissioned officers; and, a field grade Article 15 for assaulting a female. The applicant’s record shows sufficient misconduct and substandard performance to merit the discharge action under review. The Board found no evidence of arbitrary or capricious actions by the command. The Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
